Request for Additonal evidence の内容とは？失敗から学ぼう！

梅雨も明けて、夏らしい暑い日が続いていますね。

日本の夏らしさを感じることができて、気分が少し上がりますよね。

さて、サービスセンターから追加書類のリクエストが来てから、すでに1ヵ月が経ってしましました。やっと先週、彼が追加の書類を送るところまで終わり、ウェブの表示も“受け取りました”というものに変わって、安心しているところです。

追加のリクエストが来たからわかったことが多く、これからビザを申請する方のお力に少しでもなれたらと思っています。今日は私たちが求められた追加書類のリクエストの内容＋I-129f提出時の書類作成時の注意点について、シェアしていきます。

🌼求められた書類

以下の2つです。

• Intent to marry
• Two year meeting requestment

→これらが再提出になってしまった理由があります。

＜理由①Intent to marryに関して＞

私たちは既に彼を主語にしたIntent to marry letter を作成し、一番下に2人のサインをして1枚のみを提出していました。そのため、サービスセンターから私を主語にした（私の意志を記載した）書類を提出するようにと求められてしまいました。

＜理由②Two year meeting requestmentに関して＞

以前の記事にも記載しましたが、私たちの作った写真やエピソードを記入したevidence of relationshipの書類は提出してすぐに返却されてしまいました。おそらくそれが審査の対象になっていないため、すべて再提出となりました。

🌼追加書類のリクエストの詳細

以下に追加のリクエストの原文と私なりに訳したものを記載します。

・INTENT TO MARRY

Submit evidence from ○○（私の名前） that plans to marry within 90 days of her admission to the United States.

アメリカに入国後、90日以内に結婚する計画である○○（私の名前）の証拠を提出してください。

Evidence of the beneficiary’s intent may be a statement, wedding preparations or other evidence that clearly establishes her intent to marry within 90 days.

受取人の意思の証拠は、声明、結婚式の準備、または90日以内に結婚するという彼女の意思を明確に立証するその他の証拠でなければなりません。

・TWO YEAR MEETING REQUIREMENT

You submitted evidence that the beneficiary traveled to U.S.

あなた方は受取人がアメリカ合衆国に旅行をしていたという証拠を提出していました。

However, this evidence is insufficient to demonstrate that you and the beneficiary met each other in person during the two-year period immediately prior to filing the petition because, without any other supporting evidence, it cannot be determined if you met the beneficiary during any of her trips.

しかしながら、この証拠はあなたとbeneficiaryが2年の期間に実際にお互いに会っていたと証明するには不十分です。直ちに優先して申請書を提出してください。なぜなら、他の証拠を助けるものがない限り、もしあなたが彼女の旅行の間にbeneficiaryと会っていたとしても、それを判断することはでき兼ねてしまいます。

Submit evidence that you and your fiancé(e) have met each other in person at some time during the tow-year period from Match 22,2017 March 22,2019, the filing date of your petition.

2017年3月22日から2019年3月22日の2年間に、あなたとあなたの婚約者がお互いに実際に会っていたという証拠を提出してください。

Evidence may include, but is not limited to:

限り（制限）ではないが、証拠には含まれるもの：

・Your own statement which must include the date, place, and circumstances of your meeting. If you submit a personal statement it must be supported by additional evidence.

あなた方が会った日にちと場所、状況を含んでいるあなた自身の声明。あなたが個人的な声明を提出したら、それは追加の証拠として助けになるに違いないです。

・Photos (date and place of the photo must be handwritten on photos.)

写真（写真に日にちと場所が手書きされている）。

・Letters written to each other after your meeting(s), referencing the specific date and place of your meeting(s).

・Military orders or letters from commanding officers.

・Photocopies of your passport and/or your fiancé(e)’s passport, including biographical date pages and pages showing entry and exit stamps showing that you have both been present in a given location at the same time.

・Affidavits of friends, neighbors, or other knowledgeable associates. All affidavits must conform to the guidelines cited below:

Written statements sworn to or affirmed by two persons, other than yourself and the person, you are petitioning for, who were living at the time the event(s) occurred, and who have personal knowledge of the event you are trying to prove.

誓いや断言の声明はあなた自身や申請者よりも、その出来事が起きた時に過ごしており、あなたが証明しようとしている出来事の個人的な知識を持っている他の2人によって書かれている。

The persons making the affidavits may be relatives and need not be citizens of the United States.

宣言供述書を作る人々は関連のある人で、アメリカ合衆国の市民である必要はない。

Each affidavits must contain the following information regarding the person making the affidavit: his or her full name and address; date and place of birth; relationship to you (if any); full information concerning the event; and complete details concerning how her or she acquired knowledge of the event.

それぞれの宣言供述書は宣言供述書を作る人々についての情報を含まなければならない；彼または彼女のフルネームと住所；生まれた日にちと場所；あなたとの関係性（もしあれば）；出来事に関連するすべての情報；そして彼または彼女がその出来事の知識を補足するすべての詳細

・Any evidence that will help USCIS determine that you have met the beneficiary within the two years.

どんな証拠もＵＳＣＩＳがあなたがbeneficiaryに2年間の間に会ったという決定する助けになります。

If you have not met the beneficiary in person at some the during the two-year period from March 22,2017 until March 22,2019, then you must provide evidence to establish that compliance would:

1. Result in extreme hardship to you, or

結果的にあなたにとって極度に困難にある、または

2. Violate strict and long-established customs of the beneficiary’s foreign culture or social practice.

In addition to establishing that the required meeting would be a violation of custom or practice, you must also verify that all other aspects of the traditional arrangements have been or will be met in accordance with the custom or practice.

加えて、会うという要求が習慣や風習をそむくことになるということを立証し、伝統のアレンジメント（取り決め）のすべての局面が習慣や風習によって一致していることもまた確かめなければならない。

Such evidence may include, but is not limited to：

限りではないが、このような証拠を含む：

・Statements from the religious authorities attesting to the practices, beliefs, and customs from the engagement and marriage.

宗教の権威が風習、信仰、そして婚約と結婚の風習を証明する声明

・Statement from tribal leaders that establish that the meeting of the petitioner and the beneficiary is a violation of the tribe’s customs.

🌼実際に私たちが提出したもの

英語にまだまだ慣れない私にとって、追加書類のリクエストを理解することも難しかったです。さて、細かいことはさておき、私たちが提出したものは以下です。

• Intent to marry letter(Beneficiary)

     私を主語にして、アメリカへ入国後90日以内に結婚する意思があることを表示した書類。

• Photographs

　　彼や彼の家族、友達と一緒に写っている写真を印刷し、写真の裏に撮影した日にちと場所を直筆で記入　

　　したもの。

• Photocopies

　　出会いから現在までの私たちの歴史を写真付きで説明したものをＡ４サイズで作成し、6枚程度にまとめ　　　

　　たもの。

• Passport coppies

　　出入国記録としてパスポートのスタンプ部分をコピーしたもの。

　　実は、渡米した数回の内、ランダムに自動ゲートで通過していたため、スタンプがなかったので、成田

　　空港へ連絡し、スタンプを押してもらいに行きました。使用した空港に事前に連絡すると、すぐにもらえ

　　るので、ない方はご安心ください。

• Boarding passes

　　出入国記録の＋αの書類として念のため、フライトチケットをコピーし、提出しました。

• Form-I94 

　　アメリカの出入国記録も＋αの書類として念のため、提出しました。これはＩ-129Ｆのフォームの中に、

　　自身のナンバーを記載する欄があるし、記入するので必要ないと思いますが、彼が提出した方がいいと言

　　い意志か固かったので、提出しました。

• DDForm214

　　米軍の書類のコピー。

• Affidavits of petitioner's friends and family

　　彼の友達と家族に私たちが共に過ごしていたことを証明する宣言書を記載してもらい、提出しました。

🌼I-129f提出時の書類作成時の注意

追加リクエストから学んだこと、それは最初から上記の書類を提出すれば問題がないということです。USCISのインストラクションはわかりにくいです。I-129Fの書類作成時の注意点として今回は2点挙げたいと思います。

• Intent to marry は、PetitionerとBeneficiaryを主語にしたものをそれぞれ1枚ずつ、計2枚提出する。
• Evidence of relationship の書類は、PetitionerとBeneficiary以外の第三者に、２人の関係を証明してもらうことが必要です。
